Are you aware of these
Healthcare Reform Changes?

- September 2010

 
Many of our clients have been asking questions about the Health Care Reform legislation that was passed March 23, 2010.   The following is a summary of the legislation effective September 23, 2010:

  • The Affordable Care Act requires individual and group plans to cover dependents up to age 26.  Both married and unmarried children qualify for this coverage.

  • Individual and group plans can not prohibit health care coverage due to pre-existing conditions for members under the age of 19.

  • Recession of coverage must be based on “an act, practice or omission that constitutes fraud, or unless the individual makes an intentional misrepresentation of material fact”.  In this event, a 30-day advance notification of recession is required.

  • Plans will remove lifetime dollar limits on policies.  This provision applies to medical and pharmacy benefits.  Dental and vision are not included.

  • Creation of a national temporary high-risk pool. Those eligible will be individuals who have pre-existing medical conditions and have not had creditable coverage the previous six months.  California has elected to administer its own program.  Details are yet to be released.  For more information see:  www.kff.org/uninsured.
  • Please note:  Beginning January 2014, all individual and group plans must be offered on a guarantee issue basis.  This means no one can be denied coverage due to pre-existing conditions.
